3. Scope of the Agreement

These Terms and Conditions govern all purchases made through www.veronikafineart.com and apply to every order placed by customers worldwide. The Seller offers original works of art and related creative products and services directly to customers. These Terms apply regardless of whether the Buyer is acting as a consumer or as a business entity, unless mandatory consumer protection laws provide otherwise.

By placing an order through the Website, the Buyer confirms that they:

  • are at least 18 years of age or have the consent of a parent or legal guardian where permitted by applicable law;
  • have the legal capacity to enter into binding contracts;
  • provide accurate and complete information during the ordering process; and

The Seller reserves the right to refuse or cancel any order where fraudulent activity, payment irregularities, technical errors, or violations of these Terms are reasonably suspected.

4. Products and Services

4.1 Original Artworks

The Website offers original works of art created by Veronika Nagy. These may include, but are not limited to: watercolor paintings, mixed media artworks, acrylic paintings, drawings and works on paper, limited collections, and other original artworks. Unless explicitly stated otherwise, every original artwork is a unique, one-of-a-kind creation. Each artwork is individually handmade and signed by the artist. Where indicated in the product description, the artwork may also be accompanied by a Certificate of Authenticity.

4.2 Limited Edition Wearable Art

The Seller also offers limited edition wearable art products featuring reproductions of the Seller’s original artworks. Unless otherwise stated: each collection is produced in limited quantities; products may be individually numbered; slight variations between products may occur due to the production process; colours may differ slightly from those displayed on screen.

4.3 Painting Workshops

The Website may offer tickets for painting workshops and creative experiences. Workshop descriptions include, where applicable: date, location, duration, participation fee, minimum age requirements, and maximum number of participants. Participation is subject to availability. Specific cancellation policies applicable to workshops are set out in a separate section of these Terms.

4.4 Gift Cards

Gift cards may be purchased for use on eligible products or services. Unless otherwise stated: gift cards are non-refundable; gift cards cannot be exchanged for cash; gift cards may only be redeemed until their expiry date, if applicable.

4.5 Commissioned Artworks

The Seller accepts commissions for custom-made artworks subject to prior agreement. Each commissioned artwork is created according to the Buyer’s individual requirements, including, where agreed: subject matter, dimensions, colour palette, medium, and delivery schedule.

4.6 Product Information

The Seller makes every reasonable effort to ensure that all product descriptions, dimensions, photographs and other information displayed on the Website are accurate. However: colours may vary depending on the Buyer’s monitor, display settings or mobile device; slight variations in dimensions may occur due to the handmade nature of the artworks; textures, brushstrokes and surface details may appear differently in photographs than when viewed in person. These variations do not constitute defects.

4.7 Availability

All products are offered subject to availability. Because original artworks are unique, an item may become unavailable if purchased simultaneously by another customer through another sales channel. In such cases, the Seller will notify the Buyer as soon as reasonably possible and provide either a full refund or another solution agreed upon by both parties. The Seller reserves the right to discontinue any product or service at any time without prior notice.

5. Prices, Currency and Payment

5.1 Prices

All prices displayed on the Website are shown in Euro (EUR). Unless otherwise stated, prices include all applicable taxes payable by the Seller under Hungarian law but do not include shipping costs, customs duties, import taxes, or other charges that may apply in the Buyer’s country.

For products where standard shipping options are available, the applicable shipping costs are calculated during the checkout process and displayed before the Buyer places the order. For certain original artworks requiring custom packaging and individual shipping arrangements, shipping costs cannot be calculated automatically. These products are clearly marked on the Website as requiring Individual Shipping.

In such cases, the Buyer will receive a separate quotation for the packaging and shipping costs after the order has been placed. The quotation will be based on factors including the destination country, package dimensions, weight, insurance requirements, and the selected carrier. The order will become final only after the Buyer has accepted the shipping quotation and the corresponding payment has been received, where applicable.

The Seller reserves the right to change product prices at any time without prior notice. Any price changes shall not affect orders that have already been confirmed by the Seller. In the event of an obvious pricing error caused by technical malfunction or human error, the Seller reserves the right to refuse the order and refund any amount already paid.

5.2 Accepted Payment Methods

The Website currently accepts the following payment methods:

  • Online card payment via Stripe
  • Online card payment via Barion
  • Bank Transfer (SEPA and international transfers where applicable)

The availability of certain payment methods may depend on the Buyer’s country. The Seller reserves the right to modify the available payment methods at any time.

5.3 Online Card Payments

Card payments are processed securely through independent payment service providers. The Seller does not receive, store or have access to the Buyer’s full payment card details. Payments made through Stripe are subject to Stripe’s own terms and privacy policies. Payments made through Barion are subject to Barion’s own terms and privacy policies. The Buyer is responsible for ensuring that sufficient funds are available and that the payment information provided is accurate. If a payment is declined, cancelled or otherwise unsuccessful, the order will not be processed until successful payment has been received.

5.4 Bank Transfer

Where bank transfer is selected, payment must be made to the following account:

  • Account Holder: Veronika Nagy
  • Bank Account Number: 16200223-10108075
  • IBAN: HU47 1620 0223 1010 8075 0000 0000

The order will only enter production or be dispatched after the payment has been received in the Seller’s bank account. Any bank charges or transfer fees imposed by the Buyer’s bank are the sole responsibility of the Buyer.

5.5 Payment Due Date & Order Confirmation

Unless otherwise agreed in writing, payment is due immediately upon placing the order. Orders remain pending until full payment has been successfully received. The Seller reserves the right to cancel unpaid orders if payment is not received within 7 calendar days after the order has been placed.

Following successful submission of an order, the Buyer will receive an automatic acknowledgement by email confirming receipt of the order. This acknowledgement does not constitute acceptance of the order. A binding sales contract is concluded only after payment has been successfully received (where applicable) and the Seller has accepted the order and confirmed its processing by email.

5.6 Invoices, Promotional Discounts & Currency Conversion

Invoices are issued electronically in accordance with applicable Hungarian tax legislation. By placing an order, the Buyer agrees to receive electronic invoices by email. It is the Buyer’s responsibility to provide accurate billing information during checkout.

From time to time, the Seller may offer promotional discounts, coupon codes or special campaigns. Unless otherwise specified: only one promotional code may be used per order; promotional discounts cannot be exchanged for cash; discounts cannot be applied retrospectively to completed orders; the Seller reserves the right to withdraw or modify promotions at any time.

Payments are processed in Euro (EUR). If the Buyer’s payment card or bank account uses a different currency, the Buyer’s bank or payment provider may apply its own exchange rate and additional conversion fees. The Seller is not responsible for any such charges.

6. Shipping and Delivery

6.1 Shipping Destinations & Processing Times

The Seller ships products worldwide, subject to applicable shipping restrictions and carrier availability. If delivery to the Buyer’s country is not available, the Seller will inform the Buyer as soon as reasonably possible and refund any payment already received.

Estimated processing times refer to the preparation of the order before dispatch and do not include transit time: original artworks and limited edition wearable art are processed as specified on the individual product page; gift cards are delivered electronically unless otherwise stated; commissioned artworks follow the timeline agreed individually with the Buyer.

6.2 Shipping Methods & Individual Shipping Quotations

The available shipping methods depend on the product and destination country. Where standard shipping is available, the Buyer may choose from the delivery options displayed during checkout.

Certain original artworks require custom packaging and specialised shipping arrangements due to their size, value, or fragility. These products are marked on the Website as Individual Shipping. For such artworks, shipping costs cannot be calculated automatically during checkout. After the order has been placed, the Seller will prepare an individual quotation for packaging, insurance (where applicable), and shipping based on the destination, dimensions, weight, and selected carrier. The Buyer will receive the quotation by email. Shipment will be arranged only after the Buyer has accepted the quotation and any additional payment has been received, where applicable.

6.3 Delivery Times, Customs Duties & Import Taxes

Estimated delivery times vary depending on the destination and the shipping service selected. Any delivery times displayed on the Website are estimates only and are not guaranteed. The Seller is not responsible for delays caused by customs procedures, import inspections, weather conditions, strikes, transportation disruptions, force majeure events, or circumstances beyond the Seller’s reasonable control.

For deliveries outside the European Union, customs duties, import taxes, VAT, brokerage fees, and other local charges may apply. These charges are determined by the customs authorities of the destination country and are the sole responsibility of the Buyer. The Seller has no control over such charges and cannot predict their amount.

6.4 Inspection Upon Delivery & Risk of Loss

The Buyer is responsible for providing a complete and accurate delivery address. The Buyer should inspect the package immediately upon delivery. If the package appears visibly damaged, the Buyer should inspect the contents before accepting delivery where possible, request that the courier records the damage, retain the original packaging, and notify the Seller without undue delay, providing photographs of both the packaging and the damaged product.

Risk of loss or damage passes to the Buyer upon delivery of the goods to the delivery address specified by the Buyer, unless mandatory consumer protection laws provide otherwise. Where indicated in the product description, original artworks are supplied with a Certificate of Authenticity, which forms part of the artwork and should be retained by the Buyer as proof of authenticity.

7. Right of Withdrawal and Returns

7.1 Right of Withdrawal (14 Days)

If the Buyer is a consumer residing in the European Union, they have the right to withdraw from the purchase of physical products within 14 days without giving any reason, in accordance with applicable consumer protection legislation. The withdrawal period expires 14 days after the day on which the Buyer, or a third party designated by the Buyer (other than the carrier), takes physical possession of the goods.

To exercise the right of withdrawal, the Buyer must notify the Seller of their decision by sending a clear written statement by email to info@veronikafineart.com before the withdrawal period expires.

7.2 Returning Products & Refunds

Returned products must be unused and handled only to the extent necessary to establish their nature, characteristics, and functioning; returned in their original condition; returned together with any accompanying documentation, including the Certificate of Authenticity where applicable; and securely packaged to prevent damage during transport. The Buyer is responsible for arranging and paying for the return shipment unless otherwise required by applicable law.

Once the returned product has been received and inspected, the Seller will refund all payments received for the returned product, excluding any non-refundable costs permitted by applicable law, within 14 days after receiving the returned goods or satisfactory proof of return. The Buyer is liable for any diminished value of the returned product resulting from handling beyond what is necessary.

7.3 Exceptions to the Right of Withdrawal

The statutory right of withdrawal does not apply to:

  • commissioned artworks created according to the Buyer’s individual specifications;
  • personalised or customised products;
  • sealed products that are not suitable for return for hygiene or health protection reasons once unsealed (where applicable);
  • any other products exempt from the right of withdrawal under applicable consumer protection legislation.

7.4 Damaged or Incorrect Products

If the Buyer receives a product that is damaged during transport or does not correspond to the confirmed order, the Buyer should notify the Seller as soon as reasonably possible with the order number, description of the issue, and clear photographs of the product and packaging. If accepted, the Seller will replace, repair, provide a partial refund, or issue a full refund in accordance with applicable law.

7.5 Special Provisions for Original Artworks

Original artworks are unique, one-of-a-kind creations. If a returned original artwork is damaged after delivery due to improper handling, storage, framing, environmental conditions, or any other circumstances attributable to the Buyer, the Seller reserves the right to refuse the return or to reduce the refund in proportion to the loss in value, where permitted by applicable law. The Buyer is encouraged to retain the original packaging for the duration of the withdrawal period, as it is specifically designed to help protect the artwork during transport.

8. Authenticity and Artistic Characteristics

8.1 Original Works of Art & Artistic Characteristics

Unless expressly stated otherwise, all original artworks offered on the Website are unique, one-of-a-kind creations by Veronika Nagy. Each artwork is individually created by hand and may incorporate a variety of artistic techniques and materials, including watercolor, acrylic, mixed media, pencil, ink, paper, canvas, wood panels, textiles, and other artistic media.

The Buyer acknowledges that original works of art are not manufactured products. Characteristics such as visible brushstrokes, pencil or sketch marks, textured surfaces, layered materials, irregular edges, natural variations in colour, organic surface effects, and intentional artistic imperfections are integral elements of the artistic process and do not constitute defects.

8.2 Mixed Media Artworks

Some artworks incorporate layered or unconventional artistic materials, including textiles, handmade papers, fibres, natural elements, or other mixed media components. These materials form an intentional part of the artistic expression. Variations in texture, relief, surface structure, or the interaction of different materials are deliberate artistic features and shall not be interpreted as flaws or defects.

8.3 Colours, Dimensions & Care of Artworks

The Seller makes every reasonable effort to present products as accurately as possible. However, actual colours may vary due to monitor calibration, screen settings, and lighting conditions during photography. Artwork dimensions shown on the Website are approximate and refer to the unframed artwork unless otherwise stated.

To preserve the condition and longevity of original artworks, Buyers are encouraged to avoid prolonged exposure to direct sunlight, protect artworks from excessive humidity and extreme temperatures, avoid direct contact with water, handle artworks with clean hands or protective gloves, and use professional framing for works on paper. The Seller shall not be liable for deterioration resulting from improper storage, display, handling, framing, or environmental conditions after delivery.

8.4 Natural Ageing

Original artworks and handcrafted products may naturally change over time. Subtle changes such as the maturation of colours, slight softening of paper tone, natural ageing of textiles, development of surface patina, or changes associated with archival materials may occur and are considered part of the normal ageing process. Such natural ageing does not constitute a defect and shall not give rise to warranty claims.

9. Warranty and Legal Guarantees

Nothing in these Terms and Conditions shall limit or exclude any statutory rights or legal guarantees that the Buyer is entitled to under applicable consumer protection laws. Where mandatory consumer protection laws grant rights that cannot be waived or limited by contract, those rights shall prevail.

The Seller warrants that all Products supplied through the Website correspond to their description on the Website, are delivered in the agreed quantity, are free from material defects at the time of delivery, and comply with applicable law. The Seller shall not be liable for defects resulting from improper handling after delivery, accidental damage, misuse, neglect, inappropriate storage, unauthorised restoration, normal wear and tear, or natural ageing of artistic materials.

Where a defect is confirmed, the Seller may repair the Product, replace it with an equivalent item where available, offer an appropriate price reduction, or provide a refund. For unique original artworks, replacement may not be possible due to their one-of-a-kind nature; in such cases, an alternative remedy permitted by applicable law shall be offered.

10. Intellectual Property

10.1 Ownership & Purchase of an Artwork

All intellectual property rights relating to the Website and its contents (including original artworks, illustrations, paintings, photographs, product images, graphic designs, logos, and text) are owned by Veronika Nagy or are used with permission. All rights are reserved.

The purchase of an original artwork or any other Product transfers ownership of the physical object only. Unless expressly agreed in writing, no copyright or other intellectual property rights are transferred to the Buyer. The Seller retains all copyright and related intellectual property rights in the artwork, including the exclusive right to reproduce, display, publish, license, or create prints or reproductions of the artwork.

10.2 Permitted & Prohibited Uses

The Buyer may display the purchased artwork for personal, non-commercial purposes, and share photographs on personal social media accounts provided the artwork is not altered, credit to Veronika Nagy is given where possible, and the use is non-commercial.

Without prior written consent, the Buyer may not reproduce, scan, copy, or digitally reproduce the artwork; create prints or merchandise; use the artwork for advertising or commercial purposes; license or sell reproductions; mint or create NFTs or similar blockchain-based assets incorporating the artwork; or remove any copyright notice or signature.

10.3 Artificial Intelligence and Machine Learning Prohibition

The Buyer may not use, upload, reproduce, distribute, or otherwise make available any artwork, image, photograph, or other content from the Website for the purpose of training, developing, testing, or improving artificial intelligence systems, machine learning models, generative AI systems, or similar technologies without the Seller’s prior written consent. This restriction applies whether the use is commercial, academic, or non-commercial.

11. User Accounts

The Buyer may create a personal account on the Website to facilitate future purchases. The Buyer is responsible for ensuring that all information provided is accurate and for maintaining the confidentiality of their login credentials. The Seller reserves the right to suspend or terminate a User Account where the Buyer breaches these Terms, engages in fraudulent or unlawful activities, or abuses the Website.

The Buyer may request the deletion of their User Account at any time by contacting info@veronikafineart.com. Deletion shall not affect completed purchases, outstanding payment obligations, or statutory record-keeping requirements.

12. Privacy and Data Protection

The Seller processes personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (EU) 2016/679 (“GDPR”). Detailed information regarding the collection, use, storage, retention, disclosure, and protection of personal data is provided in the Seller’s Privacy Policy, which forms an integral part of the Website.

Personal data may be processed by carefully selected third-party service providers to operate the Website and fulfil customer orders, including: VITAREX STÚDIÓ Szolgáltató Kft. (hosting), MailerLite Limited (newsletter), KBOSS.hu Kft. / Számlázz.hu (invoicing), Barion Payment Zrt. and Stripe Payments Europe, Limited (payment processing), and designated shipping providers.

The Website uses cookies and similar technologies (including WooCommerce, Google Analytics, Meta Pixel, Barion, and Stripe cookies) necessary for operation, payment processing, website analytics, and marketing where consented. Further details are available in the Seller’s Cookie Policy.

13. Newsletter

Visitors to the Website may subscribe to the Seller’s newsletter voluntarily based on explicit consent. The newsletter may include information about new original artworks, limited edition collections, exhibitions, behind-the-scenes studio content, and special offers. The Seller uses MailerLite to manage newsletter subscriptions and email communications.

The Buyer may unsubscribe from the newsletter at any time by clicking the “Unsubscribe” link included in every email or contacting the Seller directly. Withdrawal of consent shall not affect the lawfulness of processing carried out before such withdrawal.

14. Force Majeure

The Seller shall not be liable for any delay or failure to perform any obligation under these Terms and Conditions where such delay or failure results from circumstances beyond the Seller’s reasonable control, including natural disasters, severe weather, war, civil unrest, epidemics, strikes, transportation disruptions, customs delays, power outages, or cyberattacks.

If a Force Majeure event continues for an extended period and makes performance of the contract impossible or commercially unreasonable, either party may terminate the affected order. Where payment has already been made for Products that cannot be supplied, the Seller will refund any amounts paid, less any non-recoverable costs permitted by applicable law.

15. Limitation of Liability

To the fullest extent permitted by applicable law, the Seller shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or in connection with the use of the Website or the purchase of Products. The Seller makes reasonable efforts to ensure that the Website operates continuously and that product information is accurate, but does not guarantee uninterrupted availability or the absence of typographical errors.

Framing and Presentation: The Buyer acknowledges that images displayed on the Website are intended for illustrative purposes only. Frames, interior settings, lifestyle photographs, or digital visualisations are provided solely to demonstrate possible presentation and scale. Unless expressly stated otherwise, frames and decorative accessories are not included with the Product.

Handmade Products: The Buyer acknowledges that original artworks and limited edition wearable art are handmade products. Minor variations in texture, brushwork, stitching, surface characteristics, dimensions, or other handcrafted details are inherent to the creative process and shall not be regarded as manufacturing defects.

Nothing in these Terms and Conditions shall exclude or limit any liability that cannot lawfully be excluded or limited under applicable law, nor affect the statutory rights of Consumers.

16. Amendments to these Terms and Conditions

The Seller reserves the right to amend or update these Terms and Conditions at any time in order to reflect changes in applicable laws, business operations, the Products or Services offered, or the operation of the Website. The most current version will always be available on the Website.

Any amendments shall not affect orders that have already been accepted by the Seller. Each order shall be governed by the version of the Terms and Conditions in force at the time the order was placed.

17. Governing Law and Dispute Resolution

These Terms and Conditions and any contracts concluded through the Website shall be governed by and construed in accordance with the laws of Hungary, without regard to its conflict of law rules. Where mandatory consumer protection laws of the Buyer’s country of residence provide a higher level of protection than Hungarian law, those mandatory provisions shall remain applicable.

Before commencing legal proceedings, the Buyer is encouraged to contact the Seller in order to seek an amicable resolution of any dispute. Where permitted by applicable law, any dispute arising out of or relating to these Terms and Conditions shall be submitted to the competent courts of Hungary.

18. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a competent court or authority, such provision shall be deemed severable from the remaining provisions. The validity and enforceability of the remaining provisions shall not be affected.

19. Entire Agreement

These Terms and Conditions, together with the Privacy Policy, Cookie Policy, and any other documents expressly referred to herein, constitute the entire agreement between the Seller and the Buyer regarding the use of the Website and the purchase of Products and Services.
